Welcome to VectorPulsing B.V. ("VectorPulsing", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, services, and facilities located at Hoofdstraat 292, 4863 LG Breda, North Brabant, Netherlands.

By accessing our website, using our services, or entering our facilities, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access our services.

VectorPulsing provides fitness training services including but not limited to:

• Personal training sessions
• Group fitness classes
• Nutrition coaching and guidance
• Fitness assessments and progress monitoring
• Access to training facilities and equipment
• Specialised fitness programmes

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.

Membership and Registration

To use our services, you must:

• Be at least 16 years of age (or have parental consent)
• Provide accurate and complete registration information
• Complete required health screening and waiver forms
• Pay applicable fees and charges
• Comply with all facility rules and policies

You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

Health and Safety

Your health and safety are paramount. By using our services, you acknowledge and agree that:

• You will obtain medical clearance if recommended by our trainers

Payment Terms

Payment terms for VectorPulsing services:

• All fees are due in advance unless otherwise agreed
• Payments can be made by cash, bank transfer, or approved payment methods
• Late payment may result in service suspension
• Refunds are subject to our cancellation policy
• Prices are subject to change with 30 days' notice

Cancellation and Refund Policy

Our cancellation policy includes:

• Session Cancellations: 24 hours' notice required to avoid charges
• Membership Cancellation: 30 days' written notice required
• Refunds: Prorated refunds available in certain circumstances
• No-shows: May be charged full session fee
• Medical Exceptions: Special consideration for documented medical reasons

Facility Rules and Conduct

All members and visitors must:

• Treat staff, other members, and facilities with respect
• Wear appropriate athletic attire and footwear
• Maintain personal hygiene standards
• Clean equipment after use
• Follow posted facility hours and access procedures
• Refrain from disruptive, inappropriate, or unsafe behaviour

Violation of facility rules may result in membership termination without refund.

Intellectual Property

All content on our website and materials, including but not limited to text, graphics, logos, images, audio clips, video, data compilations, and software, is the property of VectorPulsing or its content suppliers and is protected by international copyright laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent.

Training programmes, methodologies, and proprietary techniques developed by VectorPulsing remain our intellectual property.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.

By using our services, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.

We may take photographs or videos during training sessions for progress tracking purposes, with your explicit consent.

Limitation of Liability

To the fullest extent permitted by applicable law, VectorPulsing B.V., its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for all damages, losses, and causes of action shall not exceed the amount paid by you to VectorPulsing in the twelve (12) months preceding the incident giving rise to liability.

You acknowledge that physical exercise and fitness activities involve inherent risks of injury, and you voluntarily assume all such risks.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless VectorPulsing B.V., its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to:

• Your violation of these Terms
• Your use of our services or facilities
• Your violation of any third-party rights
• Any injury or damage caused by your actions or negligence

Governing Law

These Terms shall be interpreted and governed by the laws of the Netherlands, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of competent jurisdiction located in Breda, Netherlands, and you hereby consent to the personal jurisdiction and venue therein.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use our services will cease immediately. If you wish to terminate your membership, you may do so by providing written notice in accordance with our cancellation policy.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
